Right of Withdrawal (for Standard Goods)

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us (Maligo OG, Zelda-Kaplan-Weg 14/3, 1100 Vienna, Austria, email: care@maligotattoo.com, phone: +43 670 1999062) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached sample withdrawal form, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notice concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Exclusion of the Right of Withdrawal (Custom-Made Products / Private Label & Hygiene)

There is no right of withdrawal for contracts for the supply of goods:

1. that are not prefabricated and for whose production an individual selection or determination by you is decisive, or that are clearly tailored to your personal needs (e.g., private label products with individually designed labels/packaging or other customization according to customer specifications), and/or
2. sealed goods which are not suitable for return due to health protection or hygiene reasons, if their seal has been removed after delivery.

(Note: If an order contains both standard goods and custom-made goods, the right of withdrawal applies only to the standard goods.)

Consequences of Withdrawal (only insofar as a right of withdrawal exists)

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notice of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this repayment.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
